Terms of Service

1. Acceptance
By using ScamCheck (the “Service”), whether through our website, app, or API, you agree to these terms. If you do not agree, please stop using the Service. If you accept these terms on behalf of a company, you confirm you are authorized to bind that company.
2. Service description
ScamCheck provides scam and fraud detection analysis for educational and protective purposes. Results are probabilistic and indicative only — they are not legal, financial, or professional advice. Detection is not guaranteed: ScamCheck may miss scams (false negatives) or flag legitimate content (false positives). You and your users are responsible for any final decision.
3. Acceptable use
You may not use ScamCheck to generate false reports, abuse or overload our systems, reverse-engineer our detection logic, resell or redistribute the Service without a written agreement, build a competing service, or use it for any unlawful purpose.
4. API terms
The following apply to use of the ScamCheck API (/api/v1/scan) and developer keys:
- Authentication & keys. Each request must include a valid API key. You are responsible for keeping your keys secret and for all activity under your keys.
- Plans & limits. Usage is subject to the scan volume and rate limits of your plan. The free Developer tier is limited to 100 scans/month. Exceeding your limit may result in throttling or a request to upgrade.
- Fair use. Automated abuse, attempts to circumvent limits, or use that degrades the Service for others is prohibited.
- No resale. You may not resell, sublicense, or expose the API to third parties as your own product without a separate written agreement.
5. Data handling & privacy
Content you submit for analysis (“scan inputs”) is processed to return a result and may be stored to provide your scan history and improve detection quality. We do not sell scan inputs, and we do not share them with third parties to train their models. Detection may use third-party AI providers (e.g., Anthropic) solely to process the request. Business and Enterprise customers should send only the minimum data necessary and avoid submitting sensitive personal data where it is not required. We comply with applicable data-protection law, including India’s Digital Personal Data Protection (DPDP) Act and, where relevant, the GDPR. 6. Service levels (SLA)
We aim for high availability but the free and individual plans are provided without any uptime or support guarantee. Paid API plans (Growth and above) target 99.5% monthly uptime and prioritized support response. Enterprise customers may agree a custom SLA in a separate written contract. Scheduled maintenance and events outside our reasonable control are excluded.
7. No warranty & limitation of liability
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or that scams will be detected. To the maximum extent permitted by law, ScamCheck is not liable for any indirect, incidental, or consequential damages, nor for any fraud losses, missed scams, false positives, or decisions made based on our output. Our total aggregate liability for any claim is limited to the fees you paid to ScamCheck in the three (3) months preceding the claim. Always apply independent judgment.
8. Indemnity
You agree to indemnify and hold ScamCheck harmless from claims, damages, and expenses arising out of your misuse of the Service or API, your violation of these terms, or your violation of any law or third-party right.
9. Subscriptions, billing & taxes
Individual subscriptions are billed monthly or annually and may be cancelled at any time; refunds are available within 7 days of purchase for unused subscriptions. Business and API plans are billed per the agreed term (monthly or annual), and overage beyond your plan’s scan volume may be billed or throttled. Prices are exclusive of applicable taxes (e.g., GST), which will be added where required. Enterprise terms may be set out in a separate order form or contract, which prevails over these terms to the extent of any conflict.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these terms or for abuse. On termination, your right to use the Service and API ends; we may delete associated data in accordance with our retention practices and applicable law.
11. Changes to terms
We may update these terms. We will notify users of significant changes via email or an in-product notice. Continued use after changes take effect constitutes acceptance.
